《論法的精神》是孟德斯鳩*重要也是影響*的一部著作，被認(rèn)為是自亞里士多德之后*本綜合性的政治學(xué)著作。它以政治、法律為中心，廣涉經(jīng)濟(jì)、社會(huì)、宗教、倫理、歷史、地理等方面，是一部法學(xué)的百科全書。 全書分上下兩冊(cè)，共六卷三十一章。上冊(cè)集中闡述作者的思想，如三權(quán)分立理論、政體與法律的關(guān)系、地理環(huán)境決定論等；下冊(cè)則重在歷史與考證，考證了法國(guó)歷史上民法的羅馬法與日耳曼法的淵源與流變，以及法國(guó)封建法律理論與封建君主制。作者在該書中不是在單純地研究法律，而是試圖闡述法的精神，即揭示各種社會(huì)現(xiàn)象以及自然現(xiàn)象自身的性質(zhì)、狀態(tài)及其對(duì)法律的影響。在孟德斯鳩看來，各國(guó)的法律背后都隱藏著各種相關(guān)的社會(huì)現(xiàn)象和自然現(xiàn)象。這些社會(huì)現(xiàn)象和自然現(xiàn)象的性質(zhì)和狀態(tài)都對(duì)法律存在著影響關(guān)系，它們就像靈魂、精神一樣主宰著法律，此即“法的精神”。該書所闡述的政治法律思想對(duì)后世的政治法律實(shí)踐有著深遠(yuǎn)的影響，對(duì)各國(guó)資產(chǎn)階級(jí)政治和法律制度的確立及完善起到了極大的作用。美國(guó)獨(dú)立戰(zhàn)爭(zhēng)中的《獨(dú)立宣言》以及《美國(guó)憲法》、法國(guó)大革命中《人權(quán)宣言》都曾深受其影響。孟德斯鳩也因?yàn)檫@部著作被后世認(rèn)為是社會(huì)學(xué)、政治學(xué)以及比較法學(xué)的創(chuàng)始人。
